Welcome to Massage Insoles. The terms "Massage Insoles," "we," "us," and "our" refer to Massage Insoles, the operator of this website, online store, and all related content, features, and services (collectively, the "Services"). The Services are hosted and powered by Shopify Inc., which provides the ecommerce platform enabling us to sell products to you.

These Terms of Service (the "Terms") govern your access to and use of the Services. By accessing, visiting, or making a purchase through the Services, you agree to be legally bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

ELIGIBILITY & ACCOUNT RESPONSIBILITY

You represent that you are at least the age of majority in your jurisdiction and have legal authority to enter into this agreement. If you create an account or provide personal information, you must ensure it is accurate, current, and complete.

You are fully responsible for maintaining the security of your account credentials and all activity under your account. We are not liable for unauthorized account use.

PRODUCTS & DESCRIPTIONS

We make reasonable efforts to present accurate product information; however:

Colors, materials, and appearance may differ from what you see online

All products, descriptions, and prices may change without notice

We may limit product quantities or discontinue items at any time

We do not guarantee that any product will meet your expectations or be free from defects or variations.

ORDERS, ACCEPTANCE & CANCELLATIONS

Your order constitutes an offer to purchase. We reserve the right to accept or decline any order at our discretion. An order is not accepted until we provide written confirmation.

We may cancel or refuse an order for any reason, including errors, suspected fraud, or unavailability. If your order is declined or canceled, we may notify you using the contact information you provided.

Your purchases are governed by our Refund & Return Policy. By placing an order, you agree that all items are purchased for personal use only and not for resale.

PRICING, PAYMENTS & BILLING AUTHORIZATION

Prices may change at any time without notice. Posted prices exclude taxes, duties, shipping, and other applicable charges unless stated otherwise.

By submitting payment information, you represent and warrant that:

You are authorized to use the payment method

The payment information provided is accurate

You authorize us to charge the full amount of your order (including taxes, shipping, and recurring charges if applicable)

If your payment fails or is reversed, you remain responsible for all outstanding amounts.

SHIPPING, DELIVERY & RISK OF LOSS

Shipping times are estimates only. We are not responsible for delays caused by customs, carriers, weather, or events beyond our control.

Risk of loss and title transfer to you once an order is handed to the carrier.

SUBSCRIPTIONS, FREE TRIALS & RECURRING BILLING

Certain optional Services, including the Personalized Recovery Guide (the "Membership"), are offered on a recurring subscription basis. By enrolling in a subscription, you authorize recurring automatic charges to the payment method provided until canceled.

Free Trial. The Membership includes a 14-day free trial beginning on the date of purchase. If you do not cancel before the trial period ends, your Membership will automatically convert to a paid subscription. By completing a purchase involving a free trial, you acknowledge that charges will automatically renew after the trial unless canceled.

Billing. After the free trial, the payment method used at checkout will be automatically charged $39 USD per month until you cancel. Billing occurs on a recurring monthly basis on or around the same calendar day each month. Prices are exclusive of any applicable taxes, which may be added at checkout. We reserve the right to change subscription pricing with at least 30 days' advance notice to active subscribers; continued use of the Membership after a price change takes effect constitutes acceptance of the new price. You will also receive details of billing frequency, renewal price, and cancellation rights at checkout or in your order confirmation.

Membership Benefits. While your Membership is active, you will receive access to the monthly Personalized Recovery Guide materials, including mobility routines, stretching plans, strengthening progressions, and related content delivered by email. Benefits expire immediately upon cancellation or termination of your Membership and have no cash value.

Cancellation. You may cancel your Membership at any time through your customer account or by contacting our support team at support@massageinsoles.com. Cancellation takes effect at the end of the current billing period, and you will retain access to Membership benefits until that date. Cancellations apply to future charges only and do not entitle you to refunds for previously paid periods, except as provided in our Refund Policy or required by law.

Failed Payments. If a recurring payment fails, we may retry the charge and/or suspend your Membership benefits until payment is successfully processed.

MEDICAL DISCLAIMER; ASSUMPTION OF RISK

Our products, including Massage Insoles, and all content we provide, including the Personalized Recovery Guide materials, mobility routines, stretching plans, strengthening progressions, emails, and any other materials (collectively, "Content"), are provided for general informational and wellness purposes only. They are not medical devices intended to diagnose, treat, cure, or prevent any disease or medical condition, and the Content does not constitute medical, health, or professional advice. Nothing on this site creates a doctor-patient relationship between you and Massage Insoles or any person featured on the site.

You should consult a qualified healthcare professional before using our products or acting on any Content, particularly if you have an existing injury, foot or joint condition, diabetes, circulatory issues, or other medical condition, are recovering from surgery, are pregnant, or are taking medication. Never disregard or delay seeking professional medical advice because of something you have read on this site or received through the Membership. If you experience increased pain, numbness, swelling, or any adverse reaction while using our products or following any Content, discontinue use immediately and consult a physician.

You acknowledge that physical exercise and the use of orthotic or support products carry inherent risks. To the fullest extent permitted by law, you voluntarily assume all risks associated with your use of our products and Content, and you agree that any such use is at your own discretion and risk.

Testimonials and Results. Testimonials, reviews, and results described on this site reflect the individual experiences of specific customers and are not a guarantee, promise, or prediction of the results you will achieve. Individual results vary depending on many factors, including the nature and severity of your condition, consistency of use, and overall health.

CHARGEBACKS AND PAYMENT DISPUTES

If you have a question or concern about any charge on your account, including subscription charges, you agree to first contact us at support@massageinsoles.com and give us a reasonable opportunity to resolve the issue before initiating a chargeback or payment dispute with your bank or card issuer. We are committed to resolving billing issues quickly, and most concerns can be settled with a refund or correction within a few business days. Initiating a chargeback on a valid, properly disclosed charge may result in the suspension or termination of your account, Membership, and access to our Services. We reserve the right to dispute any chargeback we believe to be invalid and to provide the card issuer with evidence of the transaction, our disclosures, and your acceptance of these Terms.

INTELLECTUAL PROPERTY RIGHTS AND LIMITED LICENSE

All text, graphics, images, videos, trademarks, logos, product descriptions, and other content on the Services or delivered through them, including all Membership and Personalized Recovery Guide materials, are owned by Massage Insoles or our licensors and are protected by copyright, trademark, and other intellectual property laws.

Subject to your compliance with these Terms and, where applicable, payment of your Membership fees, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Content for your own personal, non-commercial use. You may not copy, reproduce, modify, share, distribute, publish, sell, resell, sublicense, or otherwise exploit any portion of the Services or Content without our express written permission. This includes, without limitation, sharing or forwarding Membership materials to non-members. This license terminates automatically when your Membership ends or if you breach these Terms, and you must cease use of any Membership materials upon termination.

THIRD-PARTY SERVICES & LINKS

We may link to third-party websites or tools that are not owned or controlled by us. We are not responsible for the accuracy, content, or practices of any third-party sites. Access them at your own risk.

PRIVACY POLICY

FEEDBACK & USER CONTENT

If you submit reviews, suggestions, or other content ("Feedback"), you grant us a perpetual, worldwide, royalty-free license to use, reproduce, modify, publish, and display such Feedback without compensation.

You represent and warrant that you own or have rights to the Feedback and that it does not violate any third-party rights.

ERRORS & INFORMATION ACCURACY

We reserve the right to correct inaccuracies, errors, or omissions on the Services at any time, including after an order is submitted.

PROHIBITED ACTIVITIES

You may not use the Services:

For unlawful purposes

To violate regulations or third-party rights

To engage in fraud, harassment, or harmful behavior

To upload viruses, bots, or malicious code

To scrape, crawl, copy, or interfere with the Services

We may terminate your access at any time for violating this section.

DISCLAIMER OF WARRANTIES

The Services and all products are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We do not guarantee uninterrupted, error-free, or secure service.

Some jurisdictions do not allow certain disclaimers; in such cases, disclaimers will apply to the fullest extent permitted.

LIMITATION OF LIABILITY

To the maximum extent permitted by law, Massage Insoles and its affiliates shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including lost profits, lost data, or business interruption, arising from your use of the Services or any products.

Our total aggregate liability shall not exceed the amount paid by you for the product giving rise to the claim.

INDEMNIFICATION

You agree to indemnify and hold harmless Massage Insoles, Shopify, and all related affiliates, directors, officers, employees, contractors, and partners from any claims, damages, or expenses (including attorney's fees) arising from your:

SEVERABILITY

ENTIRE AGREEMENT

These Terms, together with any policies linked or referenced herein, constitute the entire agreement between you and Massage Insoles regarding your use of the Services.

GOVERNING LAW

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of laws principles.

DISPUTE RESOLUTION; BINDING ARBITRATION; CLASS ACTION WAIVER

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO PARTICIPATE IN A CLASS ACTION.

Informal Resolution First. Before filing any claim, you agree to first contact us at support@massageinsoles.com with a written description of your dispute and give us 30 days to attempt to resolve it informally. Most disputes can be resolved this way.

Binding Arbitration. If we cannot resolve a dispute informally, you and Massage Insoles agree that any dispute, claim, or controversy arising out of or relating to these Terms, our products, our Services, or your Membership shall be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration shall be conducted by a single arbitrator. The seat of arbitration shall be the State of Wyoming, United States; however, you may elect to participate in the arbitration by telephone or video conference, or, where the AAA rules permit, to have the arbitration decided on written submissions. Judgment on the arbitration award may be entered in any court having jurisdiction. This agreement to arbitrate is governed by the Federal Arbitration Act.

Class Action Waiver. YOU AND MASSAGE INSOLES EACH AGREE THAT ANY DISPUTE WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.

Exceptions. Either party may bring an individual claim in small claims court if it qualifies, and either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property rights.

Opt-Out. You may opt out of this arbitration agreement and class action waiver by emailing support@massageinsoles.com within 30 days of your first purchase, stating your name, order number, and that you wish to opt out of arbitration. Opting out will not affect any other provision of these Terms.

Severability of this Section. If the class action waiver is found to be unenforceable, then the entirety of this Section 21 shall be null and void, and the dispute shall be resolved in the courts of the State of Wyoming in accordance with Section 20.

CHANGES TO TERMS

We may update these Terms at any time. Changes will become effective upon posting. Continued use of the Services constitutes acceptance of amended Terms.
